Gateway Access and Usage – Terms and Conditions

These Terms and Conditions (“Terms”) set out the rules for accessing and using the services offered by Digitalsales (SMC-Private) Limited (“we,” “us,” or “our”). By using our platform, website, APIs, or any connected service, you agree to abide by these Terms.
1. Acceptance of Terms
By accessing any part of the Digitalsales platform—including submitting transactions, using our APIs, registering as a merchant, or browsing our site—you agree to be legally bound by these Terms. If you do not accept them, you may not use our services.
2. Definitions
Platform: The digital system and APIs operated by Digitalsales for payment gateway and fintech services.
User: Any individual or entity using the Digitalsales platform.
Merchant: A registered business or individual using our APIs or platform tools.
Customer: End-users whose transactions are processed through Digitalsales.
Services: All products and features provided by Digitalsales, including API access, payment routing, and merchant tools.
3. User Responsibilities
Users must provide correct, updated information during registration and use.
Users must not use Digitalsales services for unlawful, abusive, or fraudulent activities.
Merchants must comply with all relevant laws and payment-industry standards.
4. Platform Responsibilities
Digitalsales will take reasonable steps to maintain system availability and security.
We will process transactions, routing, status updates, and refunds as per applicable policies.
5. Limitation of Liability
To the maximum extent permitted by law, Digitalsales is not responsible for:
Merchant delivery or service issues
Third-party provider failures (banks, wallets, etc.)
Indirect, incidental, or consequential damages
Liability shall not exceed the disputed transaction amount or PKR 10,000, whichever is lower.
6. Termination of Access
We may suspend or terminate access at any time, with or without notice, if any Terms are violated or for other justified reasons.
7. Force Majeure
Digitalsales is not liable for delays or service failures caused by events beyond our control, including natural disasters, internet disruptions, cyber incidents, or regulatory actions.
8. Cookies & Tracking Policy
Digitalsales may use cookies, analytics tools, and tracking technologies to enhance user experience.
Types include:
Essential Cookies: Required for core functionality.
Performance Cookies: Improve platform efficiency.
Analytics Tools: Such as Google Analytics or Meta Pixel for usage insights.
9. API Usage Policy
Permitted Use: APIs may only be used for legitimate, approved business functions.
Fair Usage: Each API key has limits such as TPS and daily quota. Misuse is prohibited.
Prohibited Activities:
Illegal financial activity
Scraping, flooding, or probing
Redirecting funds to unapproved accounts
Security: Merchants must protect API keys and report suspected breaches immediately.
Suspension: Digitalsales may throttle, suspend, or revoke API access without notice for violations.
Audit Rights: We may review API usage to ensure compliance.
10. Governing Law
These Terms fall under the laws of Pakistan. All disputes will be handled exclusively in Pakistani courts.
11. Amendments
Digitalsales may update these Terms when necessary. Continued use of the platform indicates acceptance of the changes.
